This Privacy Policy describes the type of information that we collect from our users or which our users may be required to provide. This Privacy Policy may be amended from time to time and it is your responsibility to obtain the latest version of this Privacy Policy from the LeapN website at https://leapn.life/privacy. This Privacy Policy is directly linked from the main page of the LeapN website and clearly described as a Privacy Policy in compliance with 6 Del. C. § 1202C.

Introduction

The Leapnverse Platform is a blockchain-enabled, virtual world platform, otherwise known as a metaverse, and owned by LeapN LLC, a company formed in Delaware, USA ("LeapN"). While federal laws in the USA do not explicitly require a Privacy Policy on the Leapnverse website (https://leapn.life) and other online assets, LeapN is committed to the protection of its users' privacy.

LeapN aspires to comply with the privacy laws of Delaware, including Delaware Online Privacy and Protection Act (DOPPA) and Student Data Privacy Protection Act (SDPPA).

Notice to Users

All users of the Leapnverse Platform, whether white labeled for third parties or directly provided as a service of LeapN, should be aware that LeapN collects information about users through the Internet for the purposes of record-keeping, providing metaverse game functionality, synchronization with the blockchain, and purely administrative functions. Refusal or failure to provide the required information may limit the access of the users to the Leapnverse Platform.

LeapN's Leapnverse Platform is strictly available only for users aged 18 and above.

Definition of Users

For avoidance of doubt, the term "users" refer to any person or organization (through its representative) who accesses the Leapnverse Platform or uses LeapN's online services. (DOPPA)

Additionally, user data may be compiled and provided to regulatory bodies if required for purposes of compliance with regulatory policies and laws.

Storage of User Information

User Information may be stored by LeapN for up to six (6) years from the last date of user's use of the Leapnverse Platform or such time as may be required by regulation.

LeapN does not control the data storage practices of third party service providers used by LeapN, but will endeavour to work with third party service providers that respect LeapN's privacy policies. LeapN works with third party service providers who store user data for certain periods of time.

Advertising to Children (DOPPA)

LeapN does not condone nor will LeapN allow advertising within the Leapnverse to children, who are defined herein as any user below the age of 18. As a matter of policy, LeapN does not permit users below the age of 18 to access the Leapnverse platform. Nevertheless, users who are aware of other Leapnverse users who are below the age of 18 are prohibited from advertising and marketing inappropriate content to the underaged users. Examples of inappropriate content include alcohol, tobacco, firearms, fireworks, tanning equipment and facilities, lotteries and gambling, tattoos, drug paraphernalia, and pornography.

Eavesdropping and Surveilling (11 Del. C. § 1335)

LeapN does not condone nor will LeapN allow users to trespass upon the privacy of other users by eavesdropping or surveillance. Any video and/or audio recording of user activity within the Leapnverse by a user is illegal unless it is carried out with the consent of all users who are recorded. A user who plans to record should give notice to other users that the Leapnverse space is being recorded. In addition, it is illegal and wrong to record other users in a state of undress, or to knowingly reproduce or distribute a visual depiction of nudity or sexual conduct within the Leapnverse platform.

Access to User Information

Subject to LeapN's procedures, users of the Leapnverse Platform have a right to request for information regarding their User Information which has been stored by LeapN.

For purposes of clarity, users may be required to prove their identity electronically and by processing their documents through a notary public or similar authority.

Sharing of User Information (DOPPA)

User Information may be shared by LeapN with its service providers, contractors, affiliates, and stakeholders for administrative, operational and/or compliance purposes.

For avoidance of doubt, the term "compliance" also means complying with court orders, regulatory directives, government regulatory policies, and laws in force.

For avoidance of doubt, the term "administrative" means any act carried out by LeapN or its agents or representatives for the purpose of the continued operation of LeapN, including invoicing of the user and/or maintenance of the user's account on Leapnverse Platform.

Additionally, User Information of a Leapnverse Platform user may be shared with third parties if authorized or directed by the said user.

In the event of a reorganization or a merger, LeapN may provide information to persons involved in the said reorganization or merger for purposes of the said reorganization and/or merger.

Browser "Do Not Track" (DNT) Signals (DOPPA)

LeapN relies on multiple online software providers to allow users to experience the Leapnverse fully. In the event the user turns on a "Do Not Track" signal in the user's browser, the user may be unable to experience the Leapnverse platform in its entirety, thereby causing user dissatisfaction. LeapN is also unable to control the data collection behaviour of its service providers but will make an effort to work with service providers which respect the LeapN Privacy Policy.

Correction of Incorrect / Inaccurate User Information

A user becoming aware of mistakes or inaccuracies in his or her User Information may, subject to LeapN's requirements and policy, request for the mistake or inaccuracy to be corrected. LeapN may request for information to confirm the correctness of the information being supplied by the user.

Deletion of User Information

A user may, subject to LeapN's policies, request for the user's User Information to be deleted or redacted to the extent that LeapN is able to carry out the request.

Protection Against Intrusion of Seclusion

LeapN prohibits any attempt by a user or users to intrude upon the lawful solitude or seclusion of any users within the Leapnverse platform.

Publication of Personal Matters

Users are prohibited from publishing private and personal matters of other users which take place within the Leapnverse platform without the consent of the said Leapnverse users.

Appropriation of Name or Likeness

Users who use the name or likeness (appearance) of a person without his or her consent may, in the event of a complaint by the person who owns the name or likeness (appearance), incur a penalty, including having their accounts suspended or their avatars changed. (Subject to investigation or confirmation by LeapN.)

Fair Information Practices Policy

The Fair Information Practices are a primary source of privacy law in the United States. In the event of a data breach, LeapN undertakes to inform its users within seven (7) business days thereof by posting a notice on the official LeapN website. LeapN accepts the redress principle and will support its users in lodging complaints against data processors who misuse User Information.

Protection Under Delaware Telemarketing Fraud Act

Telemarketers are prohibited from soliciting contact information from users for purposes of contacting the said users for telemarketing. Telemarketing includes, but is not limited, to email marketing, instant messaging marketing, and telephone marketing. Contact information includes, but is not limited to, social media profiles, instant messaging account details, and email addresses.
